Coke Unleashed - Program Terms & Conditions
As updated 21 February 2012: In accordance with clause 59 of these Conditions, the Promoter has made changes to these conditions by adding provisions for the Coke Unleashed Application throughout these conditions. As these changes do not lessen the Member's rights these apply immediately effective 22nd February 2012.
- The "Coke Unleashed Program" (the "Program") is conducted by Coca-Cola South Pacific Pty Ltd, ABN 50 003 029 794, trading as Coca-Cola South Pacific, of Level 9, 40 Mount Street, North Sydney NSW 2060 ("Promoter").
- By registering for the Program, individuals accept these conditions ("Conditions"). Information on how to participate in the Program, how to collect unique codes associated with the Program, how to accumulate Tokens (as defined below), how to make purchases from the Coke Unleashed Shop (as defined below) and items that can be purchased from the Coke Unleashed Shop that are listed or advertised from time to time in connection with the Program, including information at www.cokeunleashed.com.au ("Program Website") or information on the Coke Unleashed Application ("the App") form part of these Conditions.
- All references to times and dates are to times and dates in Sydney, which may be Australian Eastern Standard Time ("AEST") or Australian Eastern Daylight Time ("AEDT") depending on the date.
- The word "including" means "including without limitation" and "includes", "included" and "in particular" are also to be understood as being without limitation.
- All references to dollars or "$" are references to Australian dollars.
- Participation in the Program is only open to "Eligible Persons". An "Eligible Person" is an individual who: (i) is a resident of Australia aged 13 years, or older; (ii) is not an employee of the Promoter or any of its related corporations or any of their agencies associated with the Program; (iii) is not an employee of Coca-Cola Amatil (Aust) Pty Ltd, ABN 68 076 594 119, or its related companies; and (iv) is not a spouse, defacto spouse, parent, child or sibling (whether full, half, step or by adoption) of an excluded employee. An Eligible Person, who is under 18 years of age, must obtain the permission of a parent or guardian to participate.
- The "Program Period" opens at 0.00hrs on 1/11/10. The Promoter may terminate the Program, in whole or in part, at any time on giving both:
- 1 months' notice of the last date on which Unique Codes (as defined below) may be entered ("Final Code Entry Date"); and
- 1 months' notice of the final date on which Purchases (as defined below) ("Final Redemption Date") may be made.
These notices may be given via the Program Website and/or via the App. - Each Eligible Person who wishes to participate in the Program must be or become a member of the Program in accordance with Condition 9 ("Member") during the Program Period.
- To register as a Member of the Program, an Eligible Person must use a compatible internet browser to visit the Program Website and follow the directions published there or must use a compatible mobile phone device to download the App from either the App Store or Marketplace, or any other place where the App may be made available for download, and follow the instructions via the App. The Promoter takes no responsibility should an Eligible Person not have the software, hardware or mobile phone plan that would permit access to and use of the App. The App is free to download. Standard carrier fees will apply to the download and use of the App but there is no additional charge for the App itself. Members should check their mobile phone plan to understand whether the mobile phone service provider will charge any additional fees for the Member's use of the App. To commence the process to become a Member of the Program, an Eligible Person must confirm their agreement to these Conditions on the Program Website or via the App and must provide:
- their first and last names;
- the State in which they reside and their residential postcode;
- a current, valid e-mail address, to which correspondence from the Promoter to the person may be sent; and
- all other details requested at the Program Website.
- A Member may also register the Member's mobile phone number at the Program Website or via the App ("Registered Mobile Phone Number"). The Member must do this if they wish to enter Unique Codes (as defined below) via their Registered Mobile Phone Number.
- If the Member registers their mobile phone as a Registered Mobile Phone Number, they will be sent an SMS message from the Promoter, which the Member must reply to in accordance with the directions to complete the registration of their Registered Mobile Phone Number during the Program Period.
- There may be SMS costs associated with submitting Unique Codes or registering a Registered Mobile Phone Number. The SMS Entry Number (as defined below) is a premium SMS number. The cost of each SMS message sent to the SMS Entry Number (as defined below) will be capped at $0.25, including GST. If you have problems submitting a Unique Code by SMS or if you have queries or complaints regarding SMS, contact the SMS help desk: 1800 006 552 or by emailing cokeunleashedinfo@cokeunleashed.com.au.
- Eligible Persons must obtain the consent of the bill payer prior to sending any SMS message. To send an SMS to the SMS Entry Number, Eligible Persons must use a mobile phone and carrier service with the ability to send SMS messages to premium SMS phone numbers. Individuals should check with their carrier prior to sending any SMS message. Messages sent via SMS are deemed to be received at time of receipt into the promotional database and NOT at the time of the transmission by the individual. SMS messages sent via the internet, or via other methods other than via a mobile phone, will be deemed invalid. A Member may update details recorded by the Promoter in connection with their membership by revisiting the Program Website and following the relevant instructions published there or by contacting the Coca-Cola Consumer Information Centre on 1800 006 552 or by emailing cokeunleashedinfo@cokeunleashed.com.au. A Member must not register as a member of the Program more than once during the Program Period. A Member will have a user name and password. The Member will be responsible for the security of this password and user name, and access to and use of the Member's Token Account (as defined below).
- The Promoter reserves the right to refuse any Eligible Person's request for registration as a Member, or terminate any Member's Token Account (as defined below), at its absolute discretion, without notice, and may cause the Tokens to be forfeited without the Promoter incurring any liability to the Member.
- It is the responsibility of the Member to notify the Promoter of any change to the Member's email address and, if they have a Registered Mobile Phone Number, of a change in that number. The Promoter is not responsible for any consequences occurring as a result of the Member failing to update their contact details or otherwise to supply valid contact details.
- To participate in the Program, Members can submit Unique Codes (as defined below) from Program Packs (as defined below) for the purpose of receiving Tokens (as defined below), which can be used for Purchases (as defined below) on the Program Website or via the App during the Program Period.
- A "Program Pack" is any 450mL or 600mL, 1.25L, 1.5L or 2L PET bottle of "Coca-Cola", "Diet Coca Cola" or "Coca-Cola Zero" that:
- has been produced for sale, and sold by retail in Australia before the end of the Program Period;
- has been specially marked, with the Promoter's authority, to identify it as being included in the Program; and
- includes, on the reverse side of the label of the bottle, a unique code that has been determined by the Promoter and affixed to the packaging with its authority (a "Unique Code").
- To submit a Unique Code, a Member must:
- log on as a Member at the Program Website or via the App and follow the directions published there, including providing their user name and password and the Unique Code from the Program Pack; or
- use a mobile phone with the Member's Registered Mobile Phone Number to SMS the Unique Code from the Program Pack to 193193 ("SMS Entry Number") - Optus & Virgin $0.25 per msg sent Telstra & VHA FREE. Each Unique Code must be sent in a separate SMS.
- If a Unique Code is submitted:
- at the Program Website or via the App, the Eligible Person who submitted that Unique Code must be a Member at the time that the Unique Code is submitted or become a Member in accordance with Condition 9 before submitting that Unique Code; or
- by SMS, the Eligible Person who submitted that Unique Code must:
- Be Member at the time that Unique Code was received by the Promoter, or
- Become a Member and register their Registered Mobile Phone Number in accordance with Conditions 9, 10 and 11 within 72 hours after the Unique Code was received by the Promoter.
- If a person who is not a Member submits a Unique Code by SMS:
- they will NOT be allocated any Tokens for that Unique Code until they comply with the requirements of Condition 19(ii)(b); and
- as provided for in Condition 22, the Unique Code cannot be submitted again by SMS, or at the Program Website or via the App, by that person, or by anyone else.
- When a Member submits a Unique Code to the Promoter, and that submitted Unique Code is accepted by the Promoter, 10 Tokens will be credited to that Member's Token account (a "Token Account").
- Each Unique Code can only be submitted ONCE. A Member may not submit more than TEN Unique Codes during any period of 7 days starting at the beginning of a Monday and ending at the end of the following Sunday (a "Calendar Week") of the Program Period. A Unique Code that is received exactly on the start of a Calendar Week will be allocated to the Calendar Week that is just commencing (and not the Calendar Week that has just ended).
- Only valid Unique Codes from Program Packs will be accepted. Unrecognisable, incomplete, or invalid Unique Codes will not be accepted.
- Unique Codes cannot be used in any other program, unless otherwise specified by the Promoter.
- A Unique Code received from a Member will only result in the crediting of Tokens to the Member's Token Account if: (i) the code is recognised by the Promoter as a valid Unique Code; and (ii) that Unique Code has not been received by the Promoter before. Following the receipt of a Unique Code meeting those requirements, details of the total number of Tokens in a Member's Token Account will be available for the Member to review at the Program Website or via the App.
- Subject to Condition 27, if a code received from a Member is not recognised by the Promoter as a Unique Code, or is a Unique Code that has been received by the Promoter before, a communication to that effect (a "Try Again Message") may be sent by SMS or displayed on the Program Website shortly after the receipt of the code by the Promoter, according to the method by which the Unique Code was submitted by the Member. The Try Again Message will ask the Member to check the Unique Code on the Program Pack and to resubmit the Unique Code.
- If, in a Calendar Week of the Program Period, other than the last Calendar Week of the Program Period, more than TEN purported Unique Code submissions from a Member are received and are not accepted, no further Unique Code submissions will be accepted from that Member until the start of the next Calendar Week. If more than TEN purported Unique Code submissions from a Member are received in the last Calendar Week of the Program Period and are not accepted, no further Unique Code submissions will be accepted from that Member at all. The Promoter may send by SMS or display a communication on the Program Website or via the App to the effect that the Member has exceeded their weekly limit of Unique Codes they can submit.
- If the provisions of Condition 27 are applied to a Member five times, the Member will be disqualified from further participation in all aspects of the Program, will forfeit all their remaining Tokens and will not be eligible to make any Purchases via the Coke Unleashed Shop (as defined below) or win any prizes in any competition that may be conducted in conjunction with this Program.
- The Member acknowledges that a message sent via SMS by the Promoter in accordance with Conditions 26 or 27 may not be received by the Member, due to network coverage and availability, or because the Member's mobile phone's memory is full, or other technical issues. If the Member resubmits a code via SMS, then the Member may incur another SMS charge. The Member acknowledges that it may receive additional SMS messages in connection with the Program or any competition conducted in conjunction with the Program.
- For each Unique Code submitted by a Member, the Member MUST retain the whole of EVERY original Program Pack label that bears the Unique Code submitted, as a Member's entitlement to Tokens, to make Purchases (as defined below) via the Coke Unleashed Shop (as defined below), to enter competitions and to win prizes that may be conducted in conjunction with this Program, and may be subject to verification at the absolute discretion of the Promoter. In order to establish any such entitlement, the Promoter may ask the Member to hand over to it (at no cost to the Member) any of the original labels that this Condition requires the Member to retain. A Member MUST comply with any such request within 7 days of it being made. A Member's entitlement to Tokens, to make Purchases via the Coke Unleashed Shop (as defined below), to enter competitions and to win prizes may be declared void at the absolute discretion of the Promoter if the Member does not comply with the request within 7 days of it being made or if any original label bearing a Unique Code that is produced to the Promoter for verification, is illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way, or if the label or the Unique Code it may bear, or any part of any of them, fails the Promoter's verification for any reason.
- If in any period of ninety (90) days of the Program Period, a Member's Token Account has:
- no Tokens credited to it, or
- no Tokens redeemed from it for Purchases from the Coke Unleashed Shop (as defined below),
ALL the Points in that Member's Token Account may be forfeited (i.e. there will then be NO Points in that Member's Token Account), at the Promoter's discretion. The Promoter may also terminate the Member's registration in the Program at the Promoter's discretion. - Any Tokens that remain in a Member's Token Account at the expiration of the Final Redemption Date are forfeited at that time. The Promoter will not be liable for any loss suffered whatsoever as a result of the termination of the Program in accordance with these Conditions including, for any Tokens forfeited at the time of termination.
- The Promoter may, at any time, cancel any Tokens that are wrongly credited to a Member's Token Account, whether as a result of a Member's breach of these Conditions or an error by the Promoter or for any other reason, including technical issues.
- The Promoter, in its absolute discretion, reserves the right, from time to time, to award bonus Tokens to any Member. It is each Member's responsibility to submit their Unique Codes and redeem their Tokens in sufficient time to allow redemption of Tokens before the Final Redemption Date. Token Accounts cannot be transferred or assigned from one Member to another Member (or to anyone else), or shared by Members.
- Except as provided for in these Conditions, or otherwise specifically authorised by the Promoter, Tokens have no monetary value, or other value, and cannot be redeemed for anything other than for Purchases from the Coke Unleashed Shop (as defined below), nor redeemed as cash.
- A Member's Token Account may only be used by that Member in whose name the account is registered. Multiple individuals cannot share one Member's Token Account.
- The Promoter is not liable for any unauthorised use of a Member's Token Account, user name or password, by third parties.
- An online shop (the "Coke Unleashed Shop") will operate at the Program Website and on the App during the Program Period and up until the Final Redemption Date. Various goods and services ("Good(s)"), as listed from time to time at the Coke Unleashed Shop, will be available for purchase from the Coke Unleashed Shop.
- Only Members may make purchases from the Coke Unleashed Shop (each a "Purchase"). To make a Purchase of any Good(s), a Member must, during the Program Period and before the Final Redemption Date, log on to the Program Website or App as a Member, and follow the Purchase instructions. Further conditions that apply to making Purchases and Good(s) may be posted on the Program Website or App. Effecting a Purchase of any Good(s), constitutes acceptance by the Member of the conditions and limitations set out on the Program Website or App. It is the Member's responsibility to review and comply with these terms and conditions prior to purchasing these Good(s). The Promoter's obligations are limited to procuring the supply of the Good(s) by the relevant third party supplier.
- Good(s) that are available for Purchase from the Coke Unleased Shop may require that the Member have certain hardware or software to receive or access the Good(s). The Promoter is not responsible should the Member not have adequate hardware or software to receive such Good(s).
- A Member may only make a Purchase by redeeming the required number of Tokens from that Member's Token Account for a specific Good.
- The number of Tokens that must be redeemed to make any particular Purchase will be specified at the Coke Unleashed Shop and that number may increase, or decrease, at any time during the Program Period at the discretion of the Promoter.
- The Good(s) may be removed from the Program Website or App without notice. The Promoter gives no undertaking that any Good(s) will remain on the Program Website or App, nor that such Good(s) shall remain available to Members. Access to Good(s) may be limited in any way by the Promoter, including access for a limited time only, up to a specified quantity only (per Member or across the whole Program) or for certain Members only.
- Purchases of the Good(s) will be awarded to the Member in whose name that Token Account is held, subject to these terms and conditions.
- Members should look to the manufacturer of products and provider of services received as Good(s) for all warranties. However, these terms and conditions do not exclude or limit the application of any statutory provision (including a provision of the Trade Practices Act 1974 (or this Act by any other name or its successor legislation)) where to do so would contravene that statute or cause any part of these terms and conditions to be void. It is a condition of Member's Purchase of any Good(s), that the Member must comply with all of the conditions of use for the Good, and the requirements of the supplier of the Good.
- If a Member Purchases some Good(s) and those Good(s) are unavailable despite the Promoter's reasonable endeavours to procure them within Australia, without limiting Condition 43, the Promoter reserves the right to substitute a different item of equal or greater value or to credit the Member's Token Account with the number of Tokens that were deducted for that Purchase.
- Any values attributed to any Good(s) are correct as at the time of publication, but no responsibility is accepted for any variation in the value of any Good(s).
- Redeemed Tokens are returned to the Promoter upon redemption and the Member's Token Account will be reduced by the number of Tokens redeemed.
- The Promoter reserves the right to verify the validity of proposed Purchases and to disentitle any Member who tampers with, or subverts, the Purchase process or who submits a Purchase request that is not in accordance with these Conditions.
- At the Promoter's option, Purchased Good(s) will be delivered to the Member in one of the following ways:
- by post to the Member's postal address;
- by email (by way of voucher to be redeemable through a Promotional Partner's website); or
- by electronic download from the Program Website and/or App.
- The Promoter is not liable for any loss, theft of or damage to any Good(s) sustained in the course of delivery.
- All expenses incurred by a Member as a result of Purchasing a Good from the Coke Unleashed Shop become the responsibility of the Member.
- Where Good(s) are provided by way of a voucher redeemable through a Promotional Partner's website, any costs in excess of the voucher value and any ancillary costs associated with redeeming the voucher are the responsibility of the Member. The Promoter is not liable for vouchers that have been lost, stolen, forged, damaged or tampered with in any way. Redemption of the voucher may be subject to terms and conditions specified on the voucher, including a validity period or date of expiry.
- From time to time, the Promoter may run a competition in connection with the purchase of a specific Good, which is available for purchase in the Coke Unleashed Shop ("Promotional Good"). During the period in which a competition is being run in connection with the purchase of a Promotional Good, the Promotional Good will move from the Coke Unleashed Shop section of the Program Website and/or App to the "Shop+" segment of the Program Website and/or App.
- At the conclusion of any competition run in connection with the purchase of a Promotional Good, the Promotional Good will be removed from the Shop+ segment of the Program Website and/or and return to the Coke Unleashed Shop where it will continue to be available for purchase as a Good until such time as the Promoter amends its stock in the Coke Unleashed Shop (which the Promoter reserves the right to do at its discretion from time to time).
- Selection of Goods as Promotional Goods and timing of competitions via Shop+ is wholly at the discretion of the Promoter.
- The competitions which will be run from time to time in connection with the purchase of Promotional Goods are each subject to their own sets of specific terms and conditions, as are all other competitions run in connection with the Program Website and/or App which may be implemented from time to time by the Promoter. A Member's election to purchase a Good during the time in which it is a Promotional Good constitutes acceptance by the Member of the specific terms and conditions for the competition attached to that Promotional Good. It is the Member's responsibility to review and comply with these terms and conditions prior to electing to purchase a Good while it is a Promotional Good. Each full set of terms and conditions for the current competitions being run by the Promoter in connection with the Program can be obtained at the Program Website.
- Conditions 40 - 53, applicable to Goods available for purchase in the Coke Unleashed Shop, continue to apply to Promotional Goods for the period in which they are allocated to the Shop+ section of the Program Website and App.
- Without limiting the operation of Condition 46, from time to time the Promoter may vary these Conditions or the Program in any way, in whole or in part at any time, provided that 1 month's notice is given if the change lessens the rights of any Member. Notice may be given via the Program Website. Continued use of the Program Website following changes to these Conditions will be deemed acceptance of those changes.
- If for any reason the conduct or operation of the Program is interfered with or disrupted in any way by a cause outside the reasonable control of the Promoter (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, tampering, computer bugs or viruses or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Program.
- If a Member tampers with, or subverts, the processes relating to participation in the Program, or may benefit from such tampering or subversion by any other person, the Promoter reserves the right in its sole discretion to disqualify that Member. The Promoter reserves the right to verify the details of the Member, and request identification to establish their identity.
- The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communication line failures, theft or destruction or unauthorized access to, or alteration or non-receipt of Member's communications (including submissions of Unique Codes, and the making of Purchases). The Promoter is not responsible for any problems or technical malfunctions (such as problems with telephone networks or lines, computer systems or software or internet service providers) or any failure of any internet communication or telephone communication to be received by the Promoter (whether as a result of technical problems or traffic congestion on any carrier network, on the internet or at any website). To the full extent permitted by law, the Promoter is not liable for any injury or damage to any Member's (or any other person's) computer or resulting from or otherwise relating to participation in this Program (including by downloading materials relating to this Program), or for participation in or use of any prize or Good(s).
- CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE APP OR THE INFORMATION ON ANY WEBSITE OR APPLICATION ASSOCIATED WITH THIS PROGRAM OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS PROGRAM MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.
- Unless otherwise stipulated, rights to make Purchases, and receive any prizes or Goods are not transferable or exchangeable and cannot be taken as cash. Tokens have no value outside of this Program regardless of their allocation to any Good or prize.
- All of the Promoter's decisions are final and no correspondence will be entered into.
- The Promoter accepts no responsibility for any tax liability incurred as a result of a Member making a Purchase of any Good(s) or winning a prize. Members should obtain independent tax and financial advice.
- No responsibility is accepted for late, lost, or misdirected submission of Unique Codes, use of any Tokens, or Purchases of any Good(s) or any other communications.
- Members who make a Purchase or win a prize in any competition conducted in conjunction with the Program may be required to agree to and sign an eligibility form confirming their eligibility to make that Purchase or accept that prize (or if under 18 years of age, have their parent or guardian sign such a form on their behalf). The Promoter reserves the right to verify the age and identity of a Member prior to supplying a prize or Good.
- The Promoter is not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilised in this Program which may occur in the course of the administration of this Program.
- Any costs associated with accessing the Program Website are the responsibility of the person seeking access and are dependent on the internet service provider used. Any cost associated with accessing the App are the responsibility of the person seeking access and are dependent on the mobile service provider used.
- To the full extent permitted by law, the Promoter, its related companies and Coca-Cola Amatil (Aust) Pty Ltd (ABN 68 076 594 119) and agencies and all those entities' personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any person in connection with the Program, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death. Nothing in these Conditions is intended to exclude, restrict or modify a person's rights under the Trade Practices Act 1974 (or this Act by any other name, or its successor legislation).
- Members are able to elect to receive electronic newsletters from the Promoter and electronic Program-related updates including references to prizes and Good(s) and their respective manufacturers or providers. All Members will be given the opportunity to opt out if they do not wish to receive future newsletter and update emails. However, Members consent to receive communications from the Promoter or its delegate relating to the Program, their Token Account or Token Account balance, or their Membership, as the Promoter deems necessary for the administration of the Program, and the Promoter may deem that a Member electing to opt out of such communications wishes to forfeit participation in the Program.
- Members' personal information will be collected by or on behalf of the Promoter to enable it to administer and promote the Program and the winners of any competition. The personal information of Members may be provided to others assisting in the conduct of the Program, including the Program administrator, suppliers and deliverers, and to authorities that regulate the Program. Consumers may contact the Promoter via the Program Website or by calling the toll free number 1800 006 552 or by emailing cokeunleashedinfo@cokeunleashed.com.au to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If a Member does not provide accurate personal information the Promoter may determine that they are not eligible to make a Purchase or win a prize. Visit www.cokeunleashed.com.au to view the Promoter's privacy policy. Members acknowledge that their personal information may be supplied to organisations outside of Australia and they provide their consent for this to occur by participating in the Program.
- All trade marks are protected from commercial use by third parties. Members must not use any registered or unregistered trade marks on the Program Website or App without either the Promoter's prior written permission or the prior written permission of the relevant trade mark owner.
